Terms of Service

By accessing or using the Makoko platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business entity, you represent that you have the authority to bind that entity. If you do not agree to these terms, you must not access or use the Service.

To use the Service, you must create an account. You agree to: • Provide accurate and complete registration information. • Maintain the security of your account credentials. • Promptly notify us of any unauthorized access to your account. • Be responsible for all activities that occur under your account. You may not share account access with unauthorized parties or create accounts for the purpose of competing with Makoko.

You may use the Service only for lawful business purposes. You agree not to: • Use the Service to facilitate illegal transactions or fraud. • Attempt to reverse-engineer, decompile, or extract source code from the platform. • Use the Service to send spam, unsolicited messages, or abusive WhatsApp communications. • Interfere with the platform's infrastructure, security, or other users' access. • Scrape, harvest, or bulk-export data in ways not permitted by our API terms. • Misrepresent your identity or business to other users or to Makoko.

The Service is offered on a subscription basis with the plans described on our pricing page. • Free plan: available indefinitely with the features and limits specified. • Paid plans: billed monthly or annually in advance. You authorize us to charge your payment method on each renewal date. • Annual plans: discounted rate applied for the full year; cancellations do not result in pro-rated refunds for unused months. • You may upgrade your plan at any time; upgrades are effective immediately and prorated. • Downgrades take effect at the end of the current billing cycle. • We reserve the right to modify pricing with 30 days' advance notice.

Makoko's AI agents and automation features are designed to assist business operations. You acknowledge that: • AI agents operate based on configurations and permissions you set. You remain responsible for reviewing and approving consequential automated actions. • AI-generated insights and forecasts are probabilistic estimates — not guarantees. • You are responsible for ensuring your use of AI automation complies with applicable law, including employment and consumer protection regulations. • We may impose limits on AI agent usage based on your subscription tier.

You retain full ownership of all business data you input into the platform. You grant Makoko a limited license to process and store this data solely to provide the Service to you. We do not claim ownership of your operational data, customer records, or business intelligence. Upon account termination, your data will be exported and then deleted per our Privacy Policy.

We aim for 99.9% uptime on paid plans but do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance where possible. We reserve the right to modify, suspend, or discontinue any feature of the Service with reasonable notice. We will not discontinue the core Service for paid subscribers without at least 60 days' notice.

To the maximum extent permitted by applicable law, Makoko and its officers, employees, and affiliates shall not be liable for: • Indirect, incidental, or consequential damages arising from use of the Service. • Loss of profits, revenue, data, or business opportunities. • Damages exceeding the amount you paid to Makoko in the 12 months preceding the claim. These limitations apply regardless of the form of action and whether Makoko was advised of the possibility of such damages.

These Terms are governed by the laws of Kenya. Disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya, unless otherwise required by mandatory consumer protection law in your jurisdiction.
